"One more escapes jail"
GEORGE TOWN: Another person has been bound over on a good
behaviour bond for statutory rape. This time, it is an electrician found guilty
of raping his 12-year-old girlfriend on two occasions last year.
Sessions judge Sitarun Nisa Abdul Aziz ordered Chuah Guan Jiu, now 22, to be bound over for three years on
a RM25,000 good behaviour bond.
She said the court took into consideration that Chuah was a
young, first time offender.
“We also considered the fact that the sexual act was consensual
and that he is a school dropout,” she said when handing down the sentence.
Sitarun Nisa said that another consideration was Chuah’s
future.
Chuah, who was wearing a shirt and blue jeans, showed no
emotion when the sentence was passed.
The court had on July 20 found him guilty of raping the
girl, then aged 12 years and 10 months, at his flat in Air Itam between 7am and
1pm on July 18 last year, and between 2.25pm and 2.45pm the next day.
The offence under Section 376(1) of the Penal Code carries
a maximum jail sentence of 20 years and whipping.
On Monday, DPP Lim Cheah Yit said Chuah had coaxed the girl
into skipping school and following him back to his flat on the pretext of him
being sick.
“They were dating and the accused should have protected her
but he took advantage of her instead.
She asked him many times to take her to school but he said
he felt unwell and took her to his home,” Lim had said when pressing for a
deterrent sentence.
In mitigation, counsel Yusuf Idris said his client earned
RM30 a day and was staying with his parents and a younger sibling.
“This is his first offence. He has a fixed job now and many
years ahead of him,” he said.
Yusuf said his client had repented and urged the court not
to impose a custodial sentence in view of Chuah’s age.
The sentencing came in the wake of the case of former
national youth squad bowler Noor Afizal Azizan who was bound over for RM25,000
to be of good behaviour for five years after he pleaded guilty to the statutory
rape of a 13-year-old girl.
There was public uproar on Aug 8 when the Court of Appeal
allowed Noor Afizal’s appeal against a High Court’s decision to sentence him to
five years jail for the offence.
In a written judgment released on Monday, the Court of
Appeal said Noor Afizal, who was 19 at the time of the offence, had not been
“very much older” than the minor he had consensual sex with, had cooperated
with the police, shown remorse, and given a guarantee that he would not commit
such an offence again.

So,
where is this taking us?

(1) The judge is a woman. She should
understand better how it’s feel as a victim to a sex crime or maybe as a
mother. But she let the offender go on the ground that “as a young, first time
offender.”
~ok..so do we have to wait until he commit another crime then the
law can do something about it?
What if this happen to her own family member?
Will she has the same opinion as her judgment on this case? If a
judge does not have any gut, why care to be a judge in first place? It is
justice in your hand, justice for all of us.

~ what did they study in their law school anyway? Statutory rape
means RAPE WHETHER IT IS CONSENT OR NOT. You can’t say she wanted it too,
because sex with a minor is STATUTORY rape. That is why they used the word ‘STATUTORY’.

- what about the girl’s future?
What about the parent, the family of the victim’s future?
So now the law is about the offender future or welfare but not justice
for the victim? Is that it?
Law means to punish and for others lesson out there that IT IS
WRONG!
If the judge is so considerate and care for the offender, send him
to have treatment. Lock him up in an institution. Let the doctors fix him. Because
they are pedophile.
It is a sickness knowing any girl is so young, a kid but still have
the desire to have the sex act with her.

- this is no use anymore la..why bother? Sucks!!

- first of all, knowing that the girl is just 12 years old, he
SHOULD back away!!
Dating her already was wrong because she is just a child, what’s
more having sex with her.
Wasn’t that made the judge sick already? Thinking that any rational
man, have any desire towards a child?
But who am I to say more? These kind of men will never be educated
or have their lesson because every court in Malaysia after this will just let
them go.
Go boy! Make another offence!! Yeah..the court is care for your
welfare!!

– well, aren’t lawyer just good!!
Now, do not bother to report if your child is molested or raped.
Because if the man is poor, the court will feel sorry for him.
If the man is a success man, the court will say that he has a bright
future ahead of him.
If the man is young, the court will give him another chance for he
is young, if the man is the first offender, the court will give him another
chance to be the second offender then they can charge and punish him, then they
can teach him a lesson and educate him that SEX WITH A MINOR IS A CRIME.
Anyone say anything about the victim? Halloo…anyone is awake here?
So? What that makes us? All pedophiles around the world will come to
our country and rape our young girls.
How do you feel?
How do I feel? I feel nauseated…I feel sad..I feel humiliated,
offended, even I feel ‘molested’ by these cowards juridical system and the
people in it.
WHO CARES ABOUT THE VICTIM ANYWAY?
They are just stupid girls, a child raved
for attention that consent to the act!!
Owh..by the way, I hope the judge can sleep well…
